Scope and Responsibility
These terms of service apply to your access and use of the information literacy online (ILO) websites and all its connected services. Please read them carefully.
Alteration of the Terms of Service
ILO reserves the right to modify its Terms of Service at any time. Any revisions to the Terms will be effective immediately upon posting. The user is obligated to regularly refer to the Terms of Service and be aware of them. The continued use of the Service after the revised Terms go into effect, then constitutes of acceptance of the changes to these Terms.
The main purpose of the ILO website is to provide teaching and learning content for the development of information literacy skills, with a special focus on higher education students.
The production of the ILO website was supported through the Erasmus+ program of the European Union. More information on the project Information Literacy Online is available through the Erasmus+ project results platform (https://ec.europa.eu/programmes/erasmus-plus/projects/eplus-project-details/#project/0114e7ac-7ad0-4bb0-b429-5190eccadedc). The European Commission support for the production of this project does not constitute endorsement of the contents which reflects the views only of the authors, and the Commission cannot be held responsible for any use which may be made of the information contained therein.
ILO is hosted and provided by the Leibniz Institute for Research and Information in Education, Rostocker Straße 6, 60323 Frankfurt am Main, Germany, referred to as “DIPF” or “we”. ILO was developed by the “ILO partnering institutions”, namely University of Graz, Austria; University of Hildesheim, Germany; University of Ljubljana, Slovenia; University of Zadar, Croatia; University of Barcelona, Spain; City, University of London, Great Britain and DIPF.
Conditions of Use
The ILO website is freely accessible. In order to create a user account, you must provide your full name, an email address, your country or region of residence, a public username, and a user password. When you create an account or use another service to log in to the ILO website, you agree to maintain the security of your password and accept all risks of unauthorized access to any data or other information you provide to the ILO website. If you discover or suspect any security breaches, please let us know as soon as possible.
The ILO website reserves the right to terminate user accounts immediately if the Terms of Service or Honour Code are violated. ILO is under no obligation either to notify the user of the reason for termination or to inform the user of the termination.
Processing of personal data is necessary in order to use this platform. In addition to the registration data, the ILO website will therefore store any data that arises in the course of your use and is provided by you. In accordance with Article 6 paragraph 1 letter b. GDPR, the legal basis for this processing is the performance of the contract for the use of the ILO website.
By registering for the ILO website you agree that data about your usage behavior and learning performance will be stored and might be analyzed for scientific purposes in anonymized form. This is data such as a summary of the movement pattern of your mouse behavior. This processing is carried out exclusively for scientific and research purposes, which does not aim to publish personal data.
The DIPF or any of the ILO partnering institutions then processes the data for scientific and research purposes, for example, to evaluate which functions and applications are used particularly frequently by users in order to continuously improve the ILO website services. The data might also be forwarded to open data repositories or other research institutions than the ILO partnering institutions if it is (1) anonymized, (2) aggregated and (3) without references to the used language version. In accordance with Article 4 Z 7 GDPR the controller is DIPF. The server is located at Frankfurt am Main (Rostocker Straße 3, 60383 Frankfurt am Main), under the surveillance of the data protection supervisor of the state of Hessen, Germany.
The user has the right of access, erasure, rectification, restriction of processing, data portability and objection to data processing, whereby it is stated that the use of the ILO website is not possible without the processing of personal data.
The user is and remains the author of their copyright protected work, the “User Content”. The same applies after publication of User Content on the Platform.
It is forbidden to intentionally search for, copy, manipulate, or otherwise use any private information or information that is the intellectual property of others without having received the explicit permission of the person(s) concerned.
When you post, link or otherwise make available content to the ILO website, you grant us the right and license to use, reproduce, modify, publicly perform, publicly display and distribute your content on or through the ILO website. We may format your content for display throughout the Service, but we will not edit or revise the substance of your content itself.
The learning content of the ILO website is licensed under a CC-BY-NC licence (https://creativecommons.org/licenses/by-nc/4.0/) unless stated otherwise. Any external content (e.g. YouTube videos and links to reading resources on third party websites) may be protected by copyright.
Limitation of Liability
The services of the ILO website and all included content are provided on an “as is” and “as available” basis without warranty of any kind (express, implied or otherwise), including, without limitation, any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except insofar as any such implied warranties may not be disclaimed under applicable law.
We do not warrant that ILO website will operate in an uninterrupted or error-free manner, that ILO website is free of viruses or other harmful components, or that the courses or content provided will meet your needs or expectations. While we endeavour to keep the information up to date and correct, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability with respect to the website or the information, products, services, or related graphics contained on the website for any purpose. Any reliance you place on such information is therefore strictly at your own risk.
To the fullest extent permitted by applicable law, you agree that neither the DIPF nor any of the ILO partnering institutions will be liable for any loss or damage including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of, or in connection with, the use of this website.
Through this website, you are able to link to other websites that are not under the control of the DIPF. We have no control over the nature, content and availability of those sites. The inclusion of any links does not necessarily imply a recommendation or endorse the views expressed within them.
You agree to defend, indemnify and hold us harmless from and against any and all costs, damages, liabilities, and expenses (including attorneys’ fees, costs, penalties, interest and disbursements) we incur in relation to, arising from, or for the purpose of avoiding, any claim or demand from a third party relating to your use of the ILO website or the use of the ILO website by any person using your account, including any claim that your use of the ILO website violates any applicable law or regulation, or the rights of any third party, and/or your violation of these Terms.
The validity of these Terms and the rights, obligations, and relations of the parties under these Terms will be construed and determined under and in accordance with the laws of Federal Republic of Germany, without regard to conflicts of law principles.
